PER CURIAM.

The sole issue before us is whether the circuit court correctly dismissed the declaratory judgment action for lack of jurisdiction. We reverse and remand with instructions to allow the cause to proceed. See § 86.011, Fla. Stat. (1995); see also Allstate Ins. Co. v. Conde, 595 So.2d 1005 (Fla. 5th DCA 1992) (en banc); Travelers Ins. Co. v. Emery, 579 So.2d 798
