In resolving the instant appeal, we shall address an issue of first impression—the immunity from civil liability of retail establishments under Maryland Code (1973, 1995 Repl.Vol.), § 5-378 of the Courts and Judicial Proceedings Article (CJ). In toto, that section, as codified, now reads:

[Immunity]—Customer use of employee toilet facility in retail establishment.1<...
