The appellant, Michael Robert Meeks, was convicted of distribution of a controlled substance, a violation of § 13A-12-211, Ala. Code, 1975. The appellant stipulated that the sale occurred within three miles of a school and the appellant was sentenced to only five years' imprisonment pursuant to the mandatory enhancement provision in § 13A-12-250, Ala.Code 1975.
