In the fall of 1989 appellant, a licensed real estate broker working for Kish & Co., Inc., solicited from appellees loans of $100,000 and $50,000. Appellant solicited these loans on behalf of Bruce Loughridge and Harvey Brickman, who in return delivered to appellees a promissory note for the $150,000 secured by a second deed of trust on property located at 350-358 Linden Street in San Francisco.
