CURRY v. SINGLETARY

No. 95-3757.

679 So.2d 21 (1996)

John F. CURRY, Jr., Appellant, v. Harry K. SINGLETARY, Jr., Appellee.

District Court of Appeal of Florida, First District.

Rehearing Denied September 25, 1996.

Attorney(s) appearing for the Case

John F. Curry, pro se.

Susan Schwartz, Assistant General Counsel, Department of Corrections, Tallahassee, for Appellee.

PER CURIAM.

We elect to treat appellee's motion to relinquish jurisdiction as a confession of error. Appellee concedes that appellant's motion to amend his petition for writ of mandamus should have been granted by the lower court. We therefore REVERSE the order dismissing the petition for writ of mandamus and REMAND for further proceedings following the filing of an amended petition and appellee's filing of a responsive pleading thereto.
