This is an appeal by the defendant, Andrew L. Snider, from three misdemeanor convictions. The defendant was convicted by a jury in the magistrate court of Calhoun County of first offense driving under the influence of alcohol, in violation of W.Va. Code, 17C-5-2(d) (1994), and sentenced to twenty-four hours confinement and fined $100. He was also convicted of two counts of obstructing an officer, in violation of W.Va.
