On September 3, 1993, a bench warrant was issued in Cobb County for the arrest of Frederick Harvey. However, this bench warrant subsequently was recalled by an order entered on October 8, 1993. On October 12, 1993, a Fulton County police officer responding to a report of suspicious activity encountered Harvey who was standing with two other men.
