Defendant appeals from a judgment imposing a suspended sentence upon his conviction by a jury of abandonment by a supporting spouse in violation of G.S. § 14-322(b). He assigns error to the trial court's denial of his motion to dismiss at the close of the State's evidence and at the close of all the evidence.
