Suffolk County grand jury returned three indictments charging the defendant with rape of a child under the age of sixteen years with force. After a second trial,1 the jury convicted the defendant of the offense alleged in the first indictment and acquitted him on the two remaining indictments. The Appeals Court reversed, Commonwealth v. Richardson, 38 Mass.App.Ct. 384
