JASER v. ZONING BOARD OF APPEALS

(15247)

43 Conn. App. 545 (1996)

GEORGE JASER ET AL. v. ZONING BOARD OF APPEALS OF THE CITY OF MILFORD

Appellate Court of Connecticut.

Officially released November 12, 1996.

Attorney(s) appearing for the Case

Matthew B. Woods, city attorney, with whom, on the brief, was Cynthia C. Anger, assistant city attorney, for the appellant (defendant).

Thomas B. Lynch, for the appellees (plaintiffs).

Foti, Lavery and Daly, Js.

LAVERY, J.

The defendant appeals from the judgment of the trial court sustaining the plaintiffs' appeal and reversing the decision of the defendant Milford zoning board of appeals (board) that the plaintiffs did not suffer a hardship and were not entitled to a variance. The sole issue in this appeal is whether the trial court impermissibly substituted its judgment for that of the board. We find that it did. We reverse the decision of the trial court.
