Michael Steven Gallegos (defendant) was convicted of first-degree murder and sexual conduct with a minor under age 15. On May 24, 1991, he was sentenced to death on the first-degree murder charge and to a presumptive consecutive sentence of 20 years on the sexual conduct charge. In State v.
