The plaintiff, Raymond Flint, an employee of the defendant, National Railroad Passenger Corporation, brought an action against the defendant under the Federal Employers' Liability Act1 for injuries he sustained while attempting to lift a section of railroad track with a jack. The case was tried to the court, but the court declared a mistrial before rendering judgment. The plaintiff then filed a motion to amend his complaint...
