This case is before the court on appeal from a judgment of the Ottawa County Court of Common Pleas, which, after a trial on a request for a permanent injunction, dismissed the complaint filed by plaintiff-appellant, the Catawba Orchard Beach Association, Inc. ("the Association"). Appellant now raises the following assignment of error:

"The Trial Court erred to the prejudice of the Plaintiff...
