CORCORAN, Justice.

Defendant Anthony Marshall Spears was convicted in Maricopa County Superior Court of theft and premeditated first degree murder. The trial court sentenced defendant to death for the murder and to 4 years' imprisonment for the theft. Defendant's convictions and death sentence are automatically appealed to this court.
