The defendant was arrested after a loaded .38 caliber revolver fell out of his pocket as he was playing with one of his friends at the Staten Island ferry terminal. A speed loader with extra bullets for a different weapon was also recovered from him. He gave a written statement to the police in which he claimed that he carried the gun for protection after having been the victim of two gunpoint robberies.
