The defendant, James Minton, is charged with violating section 353 of the Agriculture and Markets Law which prohibits "overdriv[ing], * * * tortur[ing] * * * [and] injur[ing] * * * animal[s;] * * * [failure to provide proper] sustenance". The factual allegations contained in the accusatory instrument are as follows:
