The plaintiff, on behalf of his decedent, Susan Condon, instituted this medical malpractice action against the defendant physician, Joseph Weiss, for allegedly misdiagnosing a malignant tumor on Condon's foot. The trial court rendered summary judgment in favor of the defendant, from which the plaintiff appealed.
