Defendant, who was sixteen years old at the time of the offense, pleaded nolo contendere to a charge of third-degree criminal sexual conduct, MSA 750.520d; MSA 28.788(4), in exchange for the prosecutor's agreement to dismiss charges of first-degree criminal sexual conduct, breaking and entering an occupied dwelling with intent to commit criminal sexual conduct, and misdemeanor malicious destruction of personal property.
