In the afternoon of October 31, 1989, defendant-appellant, Gregory Ross, was involved in a motor vehicle accident while traveling on North Road in Warren, Ohio. Appellant's vehicle went left of center and struck a vehicle traveling in the opposite direction. As a result of this head-on collision, the driver of the other vehicle, Martha Torrora, was killed.
