Tommy Asher, along with a number of alleged co-conspirators, was charged with conspiring to possess, alter, and transport stolen motor vehicles and with various substantive crimes involving the vehicles. Asher moved to dismiss the conspiracy count on double jeopardy grounds, claiming that he previously had been convicted for participating in the same conspiracy.
