In a prior trial, defendant was found guilty of robbery in the first degree and assault in the second degree, but acquitted of criminal possession of a weapon in the third degree. This Court reversed the judgment of conviction and remanded the case for a new trial, finding that the jurors were given improper instructions with respect to both defendant's failure to testify and the burden of proof (People v Stinson, 186 A.D.2d 23)...
