Martinez, a former hostler/attendant at Union Pacific Railroad Company, filed suit pursuant to the Federal Employers' Liability Act, 45 U.S.C. §§ 5160, (FELA), after he was injured when he fell off the end of a ramp used to service locomotive engines.
