Plaintiff Mark Kirkland suffered injuries to his right fifth finger in October 1993 when an outhouse door at a National Forest Service campground slammed on it. Kirkland initiated this personal injury action two years later under the Federal Tort Claims Act, 28 U.S.C. §§ 1346 and 2671 et seq. (the "FTCA").
