I. PROCEDURAL BACKGROUND

On June 28, 1976, petitioner Albert F. Moore, Jr. was found guilty of First Degree Murder by an Essex Superior Court jury and received a sentence of life imprisonment without parole. On August 29, 1979, the Massachusetts Supreme Judicial Court affirmed Moore's conviction. See Commonwealth v. Moore, 379 Mass. 106
