The issues in this case evolve from a pat-down search of Robert L. Perry, Sr. (Perry) on the occasion of the arrest of his son, Robert L. Perry, Jr. (Perry, Jr.), for driving with a suspended driver's license. The pat-down search resulted in the seizure of three hypodermic needles and Perry's arrest for possession of drug paraphernalia.
