In this case we address for the first time the question of whether an employee's claim for bad faith against a workers' compensation insurance carrier is cognizable under Delaware law. The claim was brought by Robert C. Pierce ("Pierce"), who was injured in the course of his employment and sought compensation from his employer's workers' compensation carrier.
