Machelle Brungart (plaintiff) sued Kmart Corporation (defendant) for personal injuries sustained while shopping at a Kmart store in Baton Rouge, Louisiana, on December 21, 1990. Her husband, Rodney C. Brungart (Brungart), joined in the suit seeking damages for loss of consortium for himself and their minor child, Joshua Brungart (Joshua).
