Myers was indicted in a two-count indictment with murder made capital because it occurred during the course of a burglary, see § 13A-5-40(a)(4), Code of Alabama 1975, and with murder made capital because it occurred during the course of a robbery, see § 13A-5-40(a)(2), Code of Alabama 1975.
