The appellant, Nicholas Ramon Wilkerson, was convicted of murder made capital because it was committed during a robbery in the first degree, § 13A-5-40(a)(2), Code of Alabama 1975. Both parties, with the consent of the trial court, waived the right to a sentencing hearing before a jury, and the trial court sentenced the appellant to life imprisonment without parole, pursuant to § 13A-5-44(c), Code of Alabama...
