WILLIAMS, Judge.

Defendant, Raymond L. Bell, Jr. ("Bell"), d/b/a Raymond Bell Contractors, appeals a judgment rendered in favor of the plaintiffs, PDT, Inc. ("PDT") and its worker's compensation insurer, Highlands Insurance Company ("Highlands"), finding that Bell must indemnify Highlands under LSA-R.S. 23:1061, for benefits paid to Bell's employee. For the reasons expressed, we reverse.
