VEASEY v. STATE

No. 95-3392.

682 So.2d 1238 (1996)

Rex A. VEASEY, Appellant, v. STATE of Florida, Appellee.

District Court of Appeal of Florida, First District.

November 22, 1996.

Attorney(s) appearing for the Case

Nancy A. Daniels, Public Defender; P. Douglas Brinkmeyer, Assistant Public Defender, Tallahassee, for Appellant.

Robert A. Butterworth, Attorney General; James W. Rogers, Senior Assistant Attorney General, for Appellee.

PER CURIAM.

The judgment and conviction are affirmed. We remand, however, so that the trial court may correct a scrivener's error in the judgment, which references section 893.13(1)(a), rather than the correct statute, section 893.13(2)(a). The Circuit Court may also wish to make reference to the general attempt statute, section 777.04(1), Florida Statutes.
