Defendant-Appellant Iese Tanielu (Defendant) was charged with abuse of a family member under Hawai`i Revised Statutes (HRS) § 709-906 (1993). HRS § 709-906 provides in relevant part, that "[i]t shall be unlawful for any person, singly or in concert, to physically abuse a family or household member[.]" After a bench trial with his wife, Ruth Tanielu (Wife), as a co-defendant, Defendant was found guilty under HRS § 709-906 and was sentenced...
