Plaintiff Toshiba Funding Authority Ltd., a Turks and Caicos Islands corporation, is the owner of the PANACHE, a 96' yacht that was damaged in a storm while the vessel was moored in Thessaloniki, Greece. At the time of the damage, the PANACHE was insured under a policy issued by Defendant Somerset Marine, Inc., a New York corporation. Toshiba sued Somerset in Texas state court after Somerset refused to reimburse Toshiba...
