The trial court suppressed evidence seized from defendant's automobile when police searched it without a warrant after they stopped it for a traffic infraction. On the state's appeal of the suppression order, the Court of Appeals reversed on the ground that the "automobile exception" applied. State v. Herrin, 123 Or.App. 117, 858 P.2d 921 (1993).
