The defendants appeal from the denial of a motion to dismiss the charges against them on the grounds that each was denied his rights to a speedy trial and due process of law. The state asserts in its motion to dismiss the appeal that this court lacks subject matter jurisdiction because the order from which the defendants appeal is not a final judgment. We agree.
