Plaintiff seeks recovery of investment tax credit refunds issued to defendants, who are shareholders (and spouses of shareholders) of Wisco Industries, Inc., a Wisconsin sub-chapter S corporation. Defendants filed a counterclaim for the recovery of the refunds, which they claimed under a transition rule exception to the repeal of the investment tax credit in the Tax Reform...
