Appellant, Curtis Day, was convicted of simple assault in violation of D.C.Code § 22-504 (1996) in a bench trial before the Judge John H. Bayly, Jr. Day was sentenced to four months confinement, execution of sentence suspended as to all but two months in jail, followed by one year of supervised probation and ten dollars in court costs.
