BACKGROUND

Varis R. Aizupitis ("the defendant") was arrested on July 4, 1995, for the murder of Elizabeth Henderson which occurred at approximately 4:00 p.m. on that date. Ms. Henderson had been shot once in the right arm, the slug from the bullet penetrating her chest cavity, and once in the head by means of a .357 calibre handgun.
