LEESON, Judge.

Defendant appeals from the denial of his pretrial motion to dismiss criminal charges against him on the grounds of double jeopardy. We affirm.

On September 28, 1994, defendant was arrested for driving under the influence of intoxicants (DUII). He was taken to the police station, where he submitted to a breath test that showed that he had a blood alcohol content of .177 percent.
