BARBOUR, Chief Judge.

This cause is before the Court on the Motion for Summary Judgment filed by the Defendant Southern States Transportation, Inc. ("Southern States"). Having considered the Motion, Plaintiffs Response, Defendant's1 Rebuttal, all attachments to each, and supporting and opposing memoranda, the Court finds that the Motion is well taken and should be granted.
