Defendant Carl L. Fasbinder was issued a ticket for driving under the influence of alcohol (DUI) in violation of section 11-501(a) of the Illinois Vehicle Code (Code) (625 ILCS 5/11-501(a) (West 1992)). Police asked defendant to submit to a breath test. Defendant consented, and the test showed his blood-alcohol concentration to be 0.18.
