OPINION

RANSOM, Justice.

1. This is a retaliatory discharge suit against ADT Automotive, Inc. David Rhein claimed that he was terminated because he alerted the New Mexico Department of Occupational Health & Safety (OSHA) about respiratory safety violations at ADT's paint and body shop, and Timothy Michaels claimed that he was terminated because he was about to file a workers' compensation claim for injuries resulting from these safety violations.
