Appellant was tried and found guilty by a jury of capital murder. See TEX.PEN.CODE § 19.03(a)(2) (Vernon 1994). Because the state waived the death penalty, appellant was automatically sentenced by the trial court to life imprisonment in the Texas Department of Criminal Justice, Institutional Division.
