McCLURE, Justice.

Johnnie Russell Pickens appeals his conviction for the lesser-included offense of involuntary manslaughter. The jury found Appellant guilty, and assessed his punishment at 3 years' imprisonment in the Texas Department of Criminal Justice, Institutional Division, and a $5,000 fine.
