PLOTKIN, Judge.

We grant this application to consider whether the Appellate Division erred in ordering the trial court to consider whether justification was proved as a defense to a charge of possession of a concealed weapon. Finding that the defense of justification cannot be established under the circumstances of this case, we reverse and remand to the Appellate Division for consideration of the remainder of the merits of Smith's appeal.
