MEMORANDUM OPINION AND ORDER

DANIEL, District Judge.

This matter is before the Court on Defendant Larry Porter's Motion for Dismissal Pursuant to Rule 12(b)(1), filed May 20, 1996, wherein he argues that this Court lacks subject matter jurisdiction. As discussed below, I agree and order the case dismissed. The matter has been fully briefed, and I am well versed in the premises.
