This is an appeal from punishment assessed after remand from an earlier appeal. Appellant, Michael Joseph Bitgood Easton, was convicted by a jury of third degree felony theft.1 The trial court originally assessed punishment at 10-years confinement, probated for 10 years, and a fine of $1,000.
