Appellant, Adam Brooks, appeals from the Summit County Juvenile Court's judgment of delinquency. We reverse.

The Akron Police Department filed a complaint against the appellant in Summit J.C. Case No. 94-12-5708, alleging delinquency by reason of rape, in violation of R.C. 2907.02(A)(1)(b), an act that would constitute a felony of the first degree if committed by an adult.
