STEWART, Judge.

A grand jury indicted Leon Horne on one count of second degree murder. On April 13, 1995, a unanimous jury returned a conviction of one count of second degree murder. The trial court sentenced the defendant to serve life imprisonment without benefit of probation, parole or suspension of sentence on May 31, 1995.
