RULING ON DEFENDANT'S MOTION FOR SUMMARY JUDGMENT

POLOZOLA, District Judge.

This matter is before the Court on the defendant's motion for summary judgment. The issue before the Court is whether the defendant is the statutory employer of the plaintiff. Since this Court has jurisdiction in this case under 28 U.S.C. § 1331, the Court must apply the recent Louisiana Supreme Court's opinion in Kirkland v. Riverwood International USA, Inc.
